Description

A jury convicted appellant, Tracy James Robinson, of unlawful possession of cocaine weighing 400 grams or more with the intent to deliver.*fn1 After making an affirmative finding that appellant used a firearm during the commission of the offense, the jury sentenced appellant to 20 years' confinement and a fine of $50,000. In six points of error, appellant argues that the evidence is legally and factually insufficient to establish (1) that he knowingly and intentionally possessed the cocaine with the intent to deliver and (2) that he used a firearm in the commission of the offense. In his seventh point of error, appellant argues that the trial court erred in refusing to charge the jury on the lesser included offense of possession of cocaine. We affirm.
